Microsoft/UE: infos interopérabilité Windows aux concurrents

La Commission européenne avait décidé et la Cour de Justice européenne avait confirmé dernièrement que Microsoft devait corriger deux abus de position dominante incompatibles avec les règles européennes sur la libre concurrence:
- la vente liée de Windows avec le lecteur vidéo Windows Media Player (ce point ayant été corrigé depuis: on peut acheter le même Windows mais sans Media Player - au même prix, ce qui évidemment n'attire pas grand-monde),
- l'impossibilité pour les systèmes d'exploitation concurrents (c'est-à-dire surtout Linux) d'obtenir toutes les informations d'interopérabilité pour communiquer avec Windows.
La Commission estime maintenant conforme à sa décision la façon dont Microsoft va fournir ces informations d'interopérabilité:

Microsoft provides two separate licensing arrangements to companies wishing to obtain the interoperability information as foreseen by the 2004 Decision's remedy. The first is a “No Patent Agreement” allowing licensees access to the interoperability information, but without taking a licence for patents which Microsoft claims necessary, a claim disputed by some third parties. Microsoft has now made three changes to this licence:
* altering the terms of the licence so that it is compatible with the open source business model
* reducing the royalty to a flat fee of €10 000
* allowing effective private enforcement of warranties regarding the completeness and accuracy of the information provided.
The second licence (the “Patent Agreement”) is for the patents which Microsoft considers relevant. Microsoft will now offer a worldwide patent licence for a reduced royalty of 0.4 % of licensees’ product revenues.

Qu'est-ce que ça donne ce jargon en traduction pour les profanes: est-ce que c'est vraiment une avancée?

Et maintenant comme pour Windows Media Player, Microsoft devra peut-être séparer Internet Explorer de Windows si la plainte d'Opera est acceptée (et après quelques années de procédure)...
